Media law expert Cleland Thom offers some simple advice on an important law.
\nCopyright law protects original work. It affects PRs in two different ways:<\/p>\n

1.\tThe media may illegally use your copyright material.
\n2.\tYou may illegally use someone else’s copyright material.<\/p>\n

Copyright covers:
\n1.\tWritten words.
\n2.\tPhotos.
\n3.\tLogos.
\n4.\tMP3 \/ MP4 files.
\n5.\tImages.
\n6.\tClips from YouTube etc.
\n7.\tPage designs.
\n8.\tComputer programmes.
\n9.\tDatabases.<\/p>\n

It doesn’t cover:
\n1.\tFacts.
\n2.\tNews.
\n3.\tInformation.
\n4.\tIdeas.
\n5.\tSlogans.<\/p>\n

Who owns copyright?<\/p>\n

1.\tEmployers – not employees.
\n2.\tFreelance writers.
\n3.\tFreelance photographers.<\/p>\n

If you are distributing material to the media (images, photos, words, podcasts etc), it is your job to check the copyright and obtain necessary consents.<\/p>\n

If you have a photo that was commissioned for private or domestic use (eg: someone’s wedding photo, graduation pic etc) you must get the consent of the person who COMMISSIONED it. They have the right to veto publication. You need the consent of the PHOTOGRAPHER, too.<\/p>\n

Fair dealing<\/p>\n

EXTRACTS of copyright work can be used – free, and without consent, on two occasions:<\/p>\n

1.\tTo report current events – but you can only use words, not pix.
\nAs a guide, you should use less than a third of the original. Weigh up:
\n\tHow many extracts have been used?
\n\tWhat percentage of the original have been used?
\n\tThe percentage the extracts make up of the new article.
\n2.\tFor review purposes – words or pix. <\/p>\n

You can only use as much as you need to make your point.<\/p>\n

The conditions of fair dealing are:
\n1.\tThe copyright owner must be given sufficient credit.
\n2.\tYou must not misrepresent the work or make fun of it.
\n3.\tYou must not pass it off as your own.<\/p>\n

Don’t …
\n1.\tLift pix from the web, or anywhere else, without written consent.
\n2.\tUse videos from YouTube or elsewhere on the web, without written consent.
\n3.\tLift facts from copyright work, without checking they’re accurate.
\n4.\tUse ‘personal’ pix without written consent – see above.
\n5.\tUse frame-grabs from TV or the web without acknowledgement.
\n6.\tAlter graphics or pix and pass them off as yours.
\n7.\tDeep link to other sites and give the impression the content is yours.<\/p>\n
